Our Commitment to Privacy
Square One Debt Settlement LLC’s (“Square One”) Privacy Policy was developed
as an extension of our commitment to combine quality products and services with
integrity in dealing with our clients. The Policy is designed to assist you (each
account holder on a joint-account) in understanding how we collect, use and safeguard
the personal information you provide to us and to assist you in making informed
decisions when using our site and our products and services. When we refer to “Non-Affiliated
Third Parties”, this means different companies who are not in any way legally related
to Square One Debt Settlement, LLC.
If permitted by the laws of the state in which you reside, the initial business
(“Marketing Representatives”) that contacts you and you provide with your
public (name, address, phone, email)
and non-public (social security
number, bank account, credit card and other account)
information to may be a Non-Affiliated
Third Party that Square One has contracted with to market our debt settlement services
to consumers. If so, we have given Marketing Representatives a license that
allows them to use our name in referring to our services, the Marketing Representative
is not an employee of Square One, and the Marketing Representatives are Non-Affiliated
Third Parties – in other words, they are not part of our business and you do not
have a continuing relationship with them after you enroll.
Where legally permitted,
upon provision of your information to Marketing Representatives, you consent to
the Marketing Representative sharing all information you provided them with Square
One for confirmation that your qualify for our services, so that we may perform
services for you, and so that you can become a client of Square One.
For joint-accounts, each account holder must provide his/her information. If our
services apply to joint-consumer information, then this policy applies to both people,
and either person may opt out on behalf of one or both.
Alternatively, if required by the state where you reside, Square One employees will
collect public and non-public information directly from you and your relationship
with be directly with Square One for the entire time you participate in Square One’s
program.
Consent To Receive Electronic Records
By submitting a request for information to us and/or Marketing Representatives,
you consent to receive information in electronic format until termination of services
unless you request paper format. You may withdraw your consent to receive electronic
records and receive a paper version of any document by printing it or by mailing
a request with your name and address and sending it to the address set forth below.
You should print and retain copies of all policies, agreements and other information
for your files and later reference. You will need access to a computer with browser,
Internet access and an email account to receive electronic records. You may also
need Acrobat Reader which is available for free from http://get.adobe.com/reader/.
Electronic records may include information about settlements, agreements, questions,
policies or services.
We never request social security number, credit card, bank
account information or the like via email, so never respond to email solicitations
for sensitive information from any source. You can help to maintain
the security of your online transactions by not sharing your personal information,
login or password with anyone
Persons Under 18 or Non US Residents May Not Participate in Square One’s Program
You must be over 18 and a legal U.S. resident to participate in Square One’s program.
Neither Square One, nor our Marketing Representatives, knowingly market our services
or solicit information from minors.
California Consumer Rights
If you are a California resident, you have the right to receive: a) information
identifying any third party parties to whom we may have disclosed, within the past
calendar year, personal information pertaining to you and your family for Square
One’s direct marketing purposes; and b) a description of the categories of personal
information disclosed. To obtain such information you must make a request in writing.
Your request must include your name, address, email address and the site URL you
visited and a return address or it will not be processed. We will not honor such
requests more than once per calendar year. Requests made via email will not be accepted.

What Information Do We Collect?
When you visit our site you may provide us with two types of information: public
(address, phone, email) and non-public information you actively choose to disclose
("Active Information") and information collected, in a way not visible to you, on
an aggregate anonymous basis as you and others browse our site ("Passive Information").
Active Information Collected
We acquire information about you from the following sources:
- Public and non-public Active Information that you provide to our Marketing Representatives
in order to request services regarding your debt; and
- Information about your transactions with us, Marketing Representatives, or others.
Passive Information Collected
Cookies are a feature of web browser (Internet Explorer, FireFox, etc.) software
that allows web servers to recognize the computer used to access a site. They are
small pieces of data that are stored by a user's web browser on one site to simplify
subsequent interactions with that site by the same user or to use the information
to streamline the user's transaction on related web pages. This makes it easier
for a user to move from site to site and to complete transactions over the Internet.
Cookies should make your online experience easier and more personalized. Our site
utilizes cookies to collect information about how our site is used. Passive Information
gathered may include the date and time of visits, the site pages viewed, time spent
at our site, the sites visited just before and just after our site. If you do not
wish to transmit "cookie" information about yourself, you may turn off the cookie
function in your web browser; please consult the "Help" section of your browser
to correctly do so. Our site's servers also automatically identify and save your
computer by its Internet Protocol address which is a unique string of numbers that
is assigned to your computer by your Internet Service Provider. If you do not use
a website to enroll, we do not gather Passive Information.
How Do We Use the Information Collected?
We may share Active Information with companies that perform services for us in the
ordinary course of business, that service or process products or services you request,
that maintain or service your account and Marketing Representatives.
As permitted by law, we may share your public and/or non-public Active Information
with:
- Non-Affiliated Third Party financial service providers, such as with your creditors
to negotiate settlement of our clients’ debts (according to their written instruction)
and with parties that provide essential services as part of our program, such as
parties that facilitate electronic fund transfers; and
- Non-Affiliated Third Party non-financial service providers, unless prohibited by
law, such as:
- Marketing Representatives and companies that provide essential services such as,
customer or technology services; and
- companies that help us improve our products or services, direct marketers, parties
that may market new products or services on our behalf
We may use and share Active and/or Passive information for the following purposes
including, among others:
- to protect the confidentiality or security of your records pertaining to the consumer,
service, product, or transactions
- to protect against or prevent actual or potential fraud, unauthorized transactions,
claims, or other liability;
- for risk control or for resolving consumer disputes or inquiries;
- to persons designated in writing by you as acting in a fiduciary or representative
capacity on your behalf (lawyer, etc.);
- to the extent specifically permitted or required under other provisions of law and
in accordance with the Right to Financial Privacy Act of 1978 (12 U.S.C. 3401 et
seq. ), to law enforcement agencies (including a federal functional regulator, the
Secretary of the Treasury, with respect to 31 U.S.C. Chapter 53, Subchapter II (Records
and Reports on Monetary Instruments and Transactions) and 12 U.S.C. Chapter 21 (Financial
Recordkeeping), a State insurance authority, with respect to any person domiciled
in that insurance authority's State that is engaged in providing insurance, and
the Federal Trade Commission), self-regulatory organizations, or for an investigation
on a matter related to public safety;
- in connection with a proposed or actual sale, merger, transfer, or exchange of all
or a portion of a business or operating unit if the disclosure of nonpublic personal
information concerns solely consumers of such business or unit;
- to comply with Federal, State, or local laws, rules and other applicable legal requirements
- to comply with a properly authorized civil, criminal, or regulatory investigation,
or subpoena or summons by Federal, State, local authorities or litigation by or
against us;
- to respond to judicial process or government regulatory authorities having jurisdiction
over you for examination, compliance, or other purposes as authorized by law; and/or
- to financial auditors
We use Passive Information to gather information about our clients and to enhance
and design our site to make it easier, faster and friendlier to use. Additionally,
cookies help us know information about how many people visit our site, when they
visit and how they use our service. Passive Information may result in your viewing
of particular advertising based on your user habits for your viewing on our site
and a shopping experience customized to you in content, services and goods. Your
IP address may be used to address problems with our server or administer our site,
to confirm that you have agreed to the terms of our service agreement or received
notifications, or to gather broad demographic information about our clients. We
may also share anonymous, combined statistical data with others. For example, we
may disclose that a specific percentage of our users are between the ages of 25
and 35.
How Can You Choose Not to Permit Sharing of Certain Information, Receive Information
from Us or to Correct, Delete or Access Your Information
We may use your Active Information to contact you via phone, email or mail. When
you request that we perform services on your behalf that allows us to contact you
by phone, email or mail. However, if you wish to opt out of any form of contact
or have a preference for how we contact you, please let us know.
If you do not want us to share non-public Active Information (or certain pieces
of information you designate) with companies that help us improve our products or
services, direct marketers, or parties that may market new products or services
on our behalf; or
If you do not want Square One to contact you regarding new products or services

How Do We Secure Active Information and Passive Information?
We restrict access to Active Information about you to those employees who need to
know that information to provide services for you. We maintain physical, electronic,
and procedural safeguards that comply with federal regulations to guard such information.
After information reaches Square One, it is stored on a secure server that resides
behind firewalls designed to block unauthorized outside access.
Remember, no method
of transmission -- by mail, over the Internet, or other method of transmission is
100% secure. Therefore, while we strive to use commercially acceptable
means to protect your personal information, we cannot guarantee absolute security.
WE RESERVE THE RIGHT TO MAKE CHANGES TO THIS POLICY BY PROVIDING A REVISED VERSION
IN ACCORDANCE WITH THE LAW.
